The New York State Attorney General's Office Real Estate Finance Bureau is charged with enforcing Article 23-A of the General Business Law (the “Martin Act”).
They govern regulations and regulate the offer and sale of real estate securities, including:
- Cooperative interests in realty
- Syndications
- Intrastate offerings
You can make a complaint about:
- Developers or sponsors of condos
- Co-ops
- Homeowner's associations
- Timeshares
The Bureau does not review complaints about:
- Boards of cooperatives
- Condos
- Homeowners' associations
- Construction defects in a single unit
- Operations of Mitchell-Lama cooperatives
- Disputes between a property owner and tenant
- Timeshares located and purchased outside of New York State
Broker-dealers of real estate securities must register with the Attorney General.
